Just a few days ago, The Walt Disney Company backpeddled on its excuse that a wrongful death lawsuit should go to arbitration because the victim had subscribed to Disney+. This was met with quite a bit of backlash and raised eyebrows.
Now, according to CNBC, the case will proceed to court in Florida. Chairman of Disney Experiences, Josh D’Amaro, must have realized that the Mouse was looking rather heartless or slimy and issued the following statement:
“We believe this situation warrants a sensitive approach to expedite a resolution for the family who have experienced such a painful loss. As such, we’ve decided to waive our right to arbitration and have the matter proceed in court.“
Doctor Kanokporn Tangsuan had been vacationing with her family at Walt Disney World last October. Around 8 PM, while visiting Raglan Road Irish Pub in Disney Springs, she ordered a meal that she had been assured was allergen-free.
By 8:45 PM, Dr. Tangsuan suffered an allergic reaction inside Planet Hollywood brought on by the alleged presence of two allergens in her system: dairy and nuts. Even though she administered an EpiPen, Tangsuan was taken to a hospital, where she passed away from anaphylaxis.
I was absolutely stunned that Disney would try to use a subscription to the streaming service as a get-out-of-court card. The company had a stronger defense by saying it had no control over the staff of Raglan Road.
The Irish-themed venue most likely does not have to have employees vetted through the Walt Disney Company, so it would be difficult for them to be held accountable if one of the employees was negligent when it comes to allergens in Raglan Road’s food.
Unfortunately, we don’t have access to the tenant agreements for Disney Springs, but if they are uncovered or subject to discovery in this court case, we’ll definitely do an article!
