Disney is facing yet another lawsuit over their Typhoon Lagoon waterpark. A woman and her lawyer husband are suing Disney for $2 million over injuries she sustained after being hit by a wave at the water park in 2022.
Kimberly Panetta, 45, was on their annual family trip to the Walt Disney World resort when they visited Typhoon Lagoon. While removing her three-year old from one of the child friendly water slides, Pannetta claims she was “pummeled” by a “forceful wave” that drug her across the cement and caused “severe” road rash.
“It was so powerful it was actually dragging us under the water for several feet. I just thank God I had the sense to push her above as I was getting dragged. I knew if she was the one getting dragged she would have been cut all over.
I felt pain immediately and I looked down and there was blood. You think you’re in the happiest place on Earth and the safest place but it’s like being dragged on concrete — it’s very rough.”
After the incident, they claim Disney only offered them $250 credit.
Why is she suing for $2 million?
From the New York Post article, it seems she is suing because she didn’t have scars or marks on her legs, and now she does. The suit says she is self-conscious about it and has to “keeps her legs covered and must tolerate being hot and uncomfortable as a result.”
At 43-45 to not have any marks, scars, varicose veins, etc. on your legs before the accident was quite a feat to begin with. I could see why someone would be upset about it now, however many of us just go about our lives and wear what’s comfortable.

Her injuries ruined the trip.
The lawsuit claims that the rest of their trip was ruined as Pannetta …”was stuck limping around applying bandages, salves and creams and was forced to avoid swimming and enjoying planned visits to the parks.” The injuries caused her left leg to throb, keeping her up at night and ruining the trip.
“We had all these plans, and we had to cancel everything. I couldn’t even go in the pool where we were staying, I had to stay inside. Everything was completely ruined.”
I could see where this would cause her pain and why she would have to modify her plans to accommodate injury. $2 million seems excessive in my opinion, but I digress.
The article states they still visit the Walt Disney World resort even after this incident.
“The family takes regular trips to Disney — but said they don’t intend to return to Typhoon Lagoon.”
This incident is reportedly not stopping them from spending money with the Walt Disney Company.
Currently, the couple isn’t only suing Disney. A search found that they are also suing Hector Marmol for a separate incident over a contract dispute. Though they are unrelated.
Typhoon Lagoon is the source of several lawsuits for Disney.
This is not the first time that Disney has faced lawsuits involving injury at Typhoon Lagoon.
Previously, Emma McGuinness sued for gynocological injuries sustained from a wedgie and water impact on the Humunga Kowabunga waterslide at the park.
Laura Reyes-Merino sued over hitting her head on the same water slide and losing consciousness in the water, leading to a brain injury.
The water park does have a history of injuries and lawsuits.
My 17-year-old asked me if this lady ever signed up for Disney+ and if she opted out of the forced arbitration waiver before filing.
