The list of controversies surrounding video game publisher The Embracer Group and its relation to the Knights of the Old Republic franchise continues to grow. A new class action lawsuit was filed against one of its subsidiaries, Aspyr, due to the controversial cancelation of a DLC expansion for their HD Remaster of Star Wars: Knights of the Old Republic 2 – The Sith Lords on Nintendo Switch.
The developer was responsible for porting multiple older Star Wars games to modern consoles, such as the Jedi Knight series, The Force Unleashed, Republic Commandos and the Knights of the Old Republic games. They are also currently working on the upcoming Tomb Raider Remaster Collection.
In 2022, the company released Star Wars: Knights of the Old Republic II – The Sith Lords on Nintendo Switch and, before launch said that they would add “Restored Content DLC” that would add unreleased DLC content for the game that was planned for the original Xbox version of the game and is currently is only accessible via a mod on the Steam version.
Sadly, this past June, Aspyr announced the cancelation of the DLC and offered game codes in exchange for players to try and make up for the disappointment.

But, it appears that tactic didn’t work as now a class action lawsuit has been filed on behalf of Malachi Mickelonis and alleges that the defendants advertised KOTOR 2 as featuring Restored Content DLC in July of 2022 but failed to deliver on the promises while refusing to issue refunds. However, the issue revolving around refunds for the Switch version may fall under Nintendo’s controversial no-digital refund policy.
Mickelonis seeks various forms of relief, including but not limited to disgorgement, trial by jury and lawyer fees. It is not known how far this lawsuit will go but it will add another black eye to the brand and for both Aspyr and Embracer Group.
